Fences - City of Salisbury
There are a number of legal procedures which must be followed if you want to build or repair a fence between you and an adjoining land owner and you want the adjoining land owner to contribute to the cost. The Act that regulates this procedure is called The Fences Act, 1975. A free booklet, Fences and the Law is available by calling tel. Customer Centre on tel. 8406 8222., The Fences Act allows for the sharing of the cost of fencing work between neighbours. If there is a dispute, the Magistrates Court Division, Courts Administration Authority has the power to make decisions regarding the work itself or who pays for it. Even, if you are willing to pay for the entire cost of a dividing fence, you are still required to give notice to the adjoining owner, as they may object., The Act covers all fencing work, and includes the, Erection of a new dividing fence, Replacement, repair or maintenance of an existing fence. The Act applies to the fencing of all land, including vacant land, developed land and rural properties except Government or council land which is larger than one hectare or land forming a public road or road reserve
